1. Area of Application

The following terms and conditions apply to all business connections between the Zollner Heimtextil GmbH and the customer. The Zollner Heimtextil GmbH doesn’t accept any different conditions formed by the customer, unless there was a written agreement of validity before. (By using this Web site, you agree to be bound by these rules and regulations, as they may be modified by us at any time and posted on this Web site. In the event of a violation of these rules and regulations, we reserve the right to seek all remedies available by law and in equity.)

3. Range of Products and Conclusion of the Contract

The conditions explained on the website as well as the terms of sale will apply, if the Zollner Heimtextil GmbH approves an order. The order will be acknowledged by the Zollner Heimtextil GmbH. The Acknowledgement doesn’t refer to a binding acceptance of the order. The Acknowledgment can be combined with a declaration of acceptance. If not, the Zollner Heimtextil GmbH has the ability of accepting a customer’s offer within 3 weeks since the order’s entry.

 

4. Right of Withdrawal

The withdrawal period is 2 weeks. It starts at the earliest with the receipt of goods and these instructions. You can withdraw the contract explanation in written form without stating a reason. This can be done by letter, fax, e-mail or return of the goods. To maintain the appropriate time-limit, send the withdrawal or the goods in due time. The burden of proof lies with the customer for the dispatch.

Consequences of the revocation

In case of an effective revocation the mutually received benefits have to be returned. If the goods are sent back partially, in an inadequate state or not sent back at all, you have to pay compensation. You have to pay compensation for the deterioration of the goods and the derived benefits, if the deterioration or the uses relate to a handling which exceeds the examination of the function, attribute and quality of the goods. “Examination of the function, attribute and quality of the goods” means testing and trying several goods, how it is usually done in a retail store. By the way you can avoid the compensation payment by not using the goods as your own property as well as to neglect everything which affects the value of the goods.  (e.g. to launder sth.)

You have to bear the cost for the reshipment, if the delivered goods come up to the ordered goods and the sum of the returned goods doesn’t cross the amount of 40.00 €. Otherwise the reshipment is cost-free; the goods will be picked up at you after receiving the withdrawal by a parcel service commissioned by us.

Please appreciate, that we can’t accept not-post-paid parcels !

 Goods, which were made individual for you, or which were cut to your personal requirement (e.g. tablecloths made to your specifications, embroideries) or  which aren’t suitable for reshipment because of their constitution, are excluded from the right of withdrawal.

 The liability of making the payment has to be fulfilled within 30 days. For the customer, the period starts with the sending of the revocation or the goods, for us it starts with the arrival of them.

 

5. Minimum Order Quantity

All goods will be delivered sole, without a minimum order quantity.

 

6. Prices, Term of Payment (and Payment)

 

All features, specifications, products and prices of products and services described on this Web site, in our catalog or on price-lists are subject to change at any time without notice. We reserve the right to make changes in information about price, description, or availability without notice. We reserve the right, without prior notice, to limit the order quantity on any product and/or refuse service to any customer. Subject to goods being unsold. A Customer’s order just applies as an offer for the conclusion of a contract.

 All prices include 19% VAT, plus shipping costs.

 The payment is done by cash in advance.

Cash in advance: After we receive your order we will send an order confirmation to you with necessary data. (bank details, due amount). 1-2 weeks after receipt of payment  you will gain the ordered goods.

 

7. Delivery

Delivery takes place only within the EU, other countries on request.

Information to Delivery –Times without commitment. If an article isn’t available any more, we reserve the right to exempt from the duty to deliver.

 

8. Shipping and Handling

Shipping costs per order amount to 5,-€  within the EU (cash in advance).

If possible, all goods are delivered in one sending. If not, there are no additional costs for you.

 

Shipping in other countries

Unfortunately an order through the online-shop isn’t possible because of the different shipping costs. Please mail your request or call us (+49-8741-4100). We will make you an offer as soon as possible.

 

9. Warranty and Liability

The customer has the right to claim supplementary performance or to reverse the order (refund of purchase price), if the goods feature a deficiency at the time of delivery. Does the supplementary performance fail or is connected with disproportional costs, the customer has the right to withdraw from the contract or to claim for a adequate reduction of the purchasing  price.

 

Colour of  Products

We have made every effort to display as accurately as possible the colors of our products that appear on the Web site; however, the actual color you will see will depend on many factors, including your computer, and we cannot guarantee that your computer will accurately display our colors. To err on the side of caution it’s possible to request a colour chart on loan for at the most 3 articles.

 

Quality of Products

Quality, Colour, Amplitude, Length, Weight, Equipment or Design featuring small aberrances which can’t be technical avoided and which accord to custom and usage don’t authorize to a notice of defects. (E.g.: cotton is a product of nature, colour differences or pimples don’t give a reason to complain)

 

10. Reservation of Proprietary Rights

Until the entire payment is done, the goods stay property of the Zollner Heimtextil GmbH

 

11. Place of Fulfilment

Vilsbiburg is the place of fulfilment

 

12. Court of Jurisdiction

Landshut is the Court of Jurisdiction
